1. Our Collection Of Your Information From You
We are the sole owners of the information collected via the Services. We may collect: (i) usage and log data, (ii) general information you provide to us, and (iii) information you provide to us to be used in your actual or contemplated purchase/sell/lease of real estate.
(i) We collect the same basic information that most websites collect. Information we collect includes your IP address, device, browser, software characteristics, location, activity on our website or related to the Services, and carrier information. We collect this information to better understand how our website visitors use the Services, to provide you with individualized information or services, and to monitor and protect security of the Services.
(ii) General information you provide to us may include your name, phone number, email address, mailing address, and/or your public Facebook profile (where specific consent is given). Unless you ask us not to, we may contact you in the future to tell you about specials, new products, or services from us or our business-partners. We use this information to respond to your requests, to provide you information that we think may be of interest to you, and to operate our business as real estate brokers.
(iii) Additional information you provide to us may be used for the rendering of professional real estate services to you. In connection with real estate transactions or contemplated transactions, we collect the same customary information collected by most California licensed real estate brokers. This includes but is not limited to signatures; addresses and telephone numbers; bank account numbers (for proof of funds, if necessary); information pertaining to a transaction such as sales information, purchase price, listing price, or other contract terms; home/title insurance policy numbers or other financial information relating to the financing of real estate transactions (such as information provided to an agent by a lender or mortgage brokers, information related to the verification of a down payment typically required by a real estate purchase agreement, or information provided to an agent when a property sale “net sheet” is created); and citizenship, marital status, and mental capacity to the extent necessary to carry out a real estate transaction, but in no event extending to medical records.
Like many of the most popular websites, we use both persistent and session cookies. Session cookies provide a means for us to track your online patterns and preferences while using the Services. A persistent cookie helps us recognize you as an existing user, so you can return to our website without signing in again. We do not utilize cookies to track you across third-party websites except as otherwise expressly provided. Our system does not respond to “Do Not Track” requests at this time.
3. Indirect Collection of Your Information From Others
In addition to the information you provide, we may receive information about you indirectly from the following:
A. Multiple Listing Service (“MLS”). A MLS is a database of properties for sale/lease, disseminated to and accessible by real estate agents. The placing of a listing on the MLS allows wide exposure of the property to the marketplace. Property information submitted to a MLS describes the price, terms, and conditions under which the property is offered for sale/lease. A significant number of real estate practitioners in Southern California are participants to MLSs. Many of our local MLSs are part of a reciprocal agreement with other MLSs whereby information is shared. A MLS may further transmit listing information to third-party websites that post property listings online such as Zillow, Redfin, etc.
B. Title Companies and Escrows. Title and escrow companies receive information in order to render their professional services, and they typically assist in providing information about all aspects of a real estate transaction to the brokers and agents involved.
C. Lenders and mortgage brokers. Typically, agents and brokers will be in contact during transactions with lenders to keep informed on the progress of the lending process. During this process, we may receive personal information relating to the loan, the loan application, the buyer’s qualifications for the loan, documents requested by the lender, and/or reasons why a loan is being denied, approved or delayed.
D. City, county, state, and other agencies of government. Many aspects of a real estate transaction rely on information received from a variety of government sources. For example, the assessor will typically provide its estimate of the square footage of the house, among various other types of data concerning the property.
E. Reporting companies. Reporting companies will access public records for information concerning the property and then provide a summary of the information. This information is not typically considered “personal information.”
F. Other sources of information. Other sources of information we may receive from third parties indirectly include neighborhood advertising information; real property portals such as Realtor.com; HOA documents from HOAs; appraisers and appraisals; investigators, inspectors and contractors; and legally and contractually required disclosures generated by or at the direction of the seller.
4. Sharing Your Information
We comply with industry standards related to sharing of your information. We will not sell for profit or rent your personal information to anyone, other than as described below:
A. Sharing information to promote the sale or purchase of property. We will share information with other agents and brokers, and sellers and buyers. It is only through the sharing of information that our agents can find the right property for you to purchase or the buyer who will purchase your property, as applicable.
B. Third parties we commonly share information with. As a real estate brokerage, we will typically share your personal information with the following third parties: brokers and agents; buyers and sellers; MLSs; real estate portals such as Realtor.com; title companies and escrows; lenders; service providers such as inspectors, appraisers or reporting companies; and other third-parties as necessary to complete the transaction.
C. Sharing of information through the Multiple Listing Service (“MLS”). As previously described, we receive some of your information from the MLS. We also share some of your information through the MLS. As members of MLSs we are bound to place our listings on the MLS and provide various information including pictures, price, terms, and the conditions under which the property is offered for sale, unless the seller opts-out. As a member of the MLS, we may be eligible to receive commissions offered through the MLS by other brokers for procuring a buyer.
D. Referrals to agents/brokers. If you use the Services to request information about a property, schedule a showing, generate a market report, get an estimation of your home’s value or any similar activity, we may also share your information with one of our affiliated agents or brokers, and may retain a referral fee therefrom. Additionally, with your consent, we may share your personal information, your name and phone number with other agents and brokers for purposes of referring you to another brokerage. For this we may negotiate a referral fee in line with the traditional model of brokerage referral relationships.
E. Other referrals. Referrals other than to agents and brokers such as escrow or title company, mortgage broker, lender, or other settlement services provider do not typically involve a referral fee. In those limited situations where a referral fee would be legally permitted, our agents will disclose it to you before receiving a referral fee from a service provider.
F. To Comply With Applicable Law and Related Requests. We may share your information to meet with applicable law, regulation, legal process, governmental, and/or association of REALTOR® requests. Additionally, in certain real estate transactions, our agents may assist in communicating to the title company information that the title insurance company it is legally required to collect under US Treasure Department anti-money laundering laws, which includes a tax ID, driver’s license, passport number, and professional or employment related information.
G. Other Sharing. We may share your information not for profit when necessary to protect ours or another’s rights or property, and as needed to those who provide us with support such as insurance, legal support, email marketing, fraud prevention, and information storage.
We do not sell information that constitutes California customer records under California Civil Code section 1798.80(e), protected classification characteristics under California or federal law, biometric information, non-public education information, and/or inferences drawn from other personal information.
5. Storage of Your Information
We hold transaction documents at least three years, and take commercially reasonable efforts to protect your information. Only personnel who need the information to perform a specific job are granted access to personally identifiable information. Despite our efforts, there is always the possibility of a breach of data transmission or storage. Please refer to the U.S. Federal Trade Commission’s website for information on how to protect yourself.
6. Locations Of Use
We only market within the United States of America. We do not knowingly collect or transfer any personal data information to those located outside of the United States of America. Users of the Services online represent and warrant that they are residents of the United States of America who are physically located in the United States of America. Individuals may only utilize the Services outside of the United States of America by contacting us via U.S mail or telephone to avoid any digital transmission of their personal information.
The Services contain or are embedded with links to other sites, including various social media sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. Using your social media account for your login or sharing via social media links embedded in our site may provide us with access to your public profile on such social media site. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site.
8. Children Under the Age of 13
Our website is not intended for or marketed towards minors. We do not knowingly collect personal information from children under the age of 13. If you are under 18, please do not provide any information or use the Services.

A. Access to Specific Information. You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive a request following the procedures set forth herein, we will disclose you the information outlined in the California Civil Code section 1789.110.
B. Deletion Request Rights. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. You must make a request following the procedures set forth herein. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. Please be advised that for the MLS to delete your personal information, you must contact the MLS directly. Additionally, we may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Retain transaction files or comply with any other legal obligation. Brokers are required to hold all transaction files for a period of at least three years under California law. However, other information may be required to be held for longer periods.
- Complete the transaction for which the personal information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you. For example, we will not delete your personal information while we are representing you in your real estate transaction.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
- Debug to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when of our information is likely to render impossible or seriously impair the achievement of such research, so long as you have provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided it.
C. How to Exercise Your Access and Deletion Rights. To exercise the access and deletion rights described above, please submit a verifiable consumer request to us by calling us at (888) 992-4310, using the “Contact” feature of interososoutherncalifornia.com, or writing to Intero Real Estate Services, Attn: Legal, 10641 Church Street, Rancho Cucamonga, CA 91730. You may only make a request for access to or disclosure of your personal information twice within a 12-month period. Your request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with personal information if we are unable to verify your identity or authority to make the request and confirm the personal information relates to you. If you provide us with personal information in your request, we will only use it to verify the requestor’s identity or authority to make the request.
D. Responses to Access and Deletion Requests. We will try to respond to your request within 45 days of our receipt of a verified request. If we require more time, we will inform you of the reason and extension period in writing. If you have an account with us, we may deliver our written response to that account. If you do not have an account with us, we may deliver our written response by mail or electronically. Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.
E. Costs of Access and Deletion Requests. We will not charge a fee to process or respond to your request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
F. Personal Information Sales Opt-Out and Opt-In Rights. If you are 16 years of age or older, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not knowingly collect (or sell) the personal information of consumers who are less than 16 years of age. Consumers who opt-in to personal information sales may opt-out of future sales at any time. G. Non-Discrimination. We will not discriminate against you for exercising any of your rights set forth above. Unless legally permitted, we will not deny you goods or services; charge you different prices or rates for goods or services or impose penalties; or provide a different quality of goods or services. However, we may offer you certain financial incentives permitted by the law that can result in different prices, rates, or quality levels. Any legally permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
